Acceptance of Terms

Your access to and use of Snooze Lane is conditional on your acceptance of and compliance with these Terms. If you do not agree with any part of the terms, then you may not access the service.

Age Requirements

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you may not use the Service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice before any new terms take effect. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Service Use

Snooze Lane provides a wake-up call service intended to alert users at their specified destination. Users must ensure their device settings allow for the correct functioning of the service.

Service Availability and Disclaimers

Snooze Lane does not guarantee that the Service will be available at all times or that it will function without errors. The Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control. Snooze Lane is not responsible for any consequences resulting from Service unavailability, including but not limited to missed stops, delays, or any personal or property damage. You acknowledge that the Service relies on various factors including GPS accuracy, network connectivity, device compatibility, and user settings, all of which may affect the Service's performance.

Communications Consent

Text Messages and Calls:

By creating an account and using the Snooze Lane service, you agree to receive pre-scheduled telephone calls and text messages from or on behalf of Snooze Lane. These communications will include:

  • Alerts via calls to notify you when you are nearing your selected destination as a unique feature of our service.
  • Text messages containing one-time passcodes (OTPs) for verifying your phone number and for secure logins to the app.

The number of text messages and calls you receive from us will vary depending on how you use our services.

Costs and Fees:

Text messaging and data rates may apply to each text message or call sent or received in connection with Snooze Lane messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans).

How to Opt-Out:

You can opt out of receiving text messages from us by replying with the word "STOP" from the mobile device receiving the messages. To stop receiving calls, you may use the in-app settings to turn off the wake-up call feature.

Your Obligations:

You represent that you are the owner or authorized user of the mobile device you use to sign up for the Snooze Lane service, and that you are authorized to approve the applicable charges.

Changes to Your Contact Information:

You agree to notify us promptly if your phone number changes by updating your account information or by contacting Customer Service at the contact information below.

By consenting to Snooze Lane's communication policies, you also accept the risk that this service may not operate as intended due to circumstances beyond our control, including but not limited to signal strength, device settings, and device compatibility with our service.

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Snooze Lane and its licensors. The Service is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

Conduct

You agree not to use the service to:

  1. Violate any laws or regulations.
  2. Infringe the intellectual property rights of others.
  3. Transmit any harmful or illegal content.
  4. Attempt to gain unauthorized access to the Service or its related systems.
  5. Interfere with or disrupt the Service or servers connected to the Service.

In-App Purchases and Subscriptions

Snooze Lane offers premium features through in-app purchases and subscriptions available via Apple's App Store:

  • Payment Processing: All payments are processed through Apple's App Store payment system. We do not collect or store your payment information.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Subscription Management: You can manage your subscriptions, including cancellation and auto-renewal settings, through your Apple ID account settings in the App Store or device Settings. Cancellation will take effect at the end of the current billing cycle.
  • Free Trials: If we offer a free trial, your subscription will automatically begin after the trial period ends unless cancelled at least 24 hours before the trial expires.
  • Price Changes: We reserve the right to modify subscription prices. We will notify you of any price changes, and your continued use of the Service after the change constitutes acceptance of the new pricing.
  • Premium Features: Premium subscriptions provide access to enhanced features. Access to premium features will continue as long as your subscription remains active.

Refunds and Cancellation

You may cancel your subscription at any time through your Apple ID account settings in the App Store or device Settings. Cancellation will take effect at the end of the current billing period, and you will continue to have access to premium features until that time.

Refund Policy: Refund requests for in-app purchases and subscriptions must be submitted through Apple's App Store refund process. Apple's standard refund policy applies. We do not process refunds directly. To request a refund, please contact Apple Support or use the refund request feature in your App Store purchase history.

If you believe you are entitled to a refund under applicable law, please contact us at the email address provided below, and we will work with Apple to process your request.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SNOOZE LANE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNOOZE LANE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL SNOOZE LANE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO SNOOZE LANE IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Snooze Lane, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your use of the Service caused damage to a third party.

Data Security

While we implement reasonable security measures to protect your data, no method of transmission over the Internet or electronic storage is 100% secure. You acknowledge that you provide your personal information at your own risk. We cannot guarantee absolute security of your data.

Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Force Majeure

Snooze Lane shall not be liable for any failure or delay in performance under these Terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, internet outage, telecommunications failure, power failure, or any other cause beyond our reasonable control.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New Jersey. You waive your right to a jury trial and to participate in a class-action lawsuit or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

Waiver

The failure of Snooze Lane to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Snooze Lane.

Entire Agreement

These Terms constitute the entire agreement between you and Snooze Lane regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.
